"Supreme Court Denies Company’s Ephedra Appeal"
The Supreme Court recently denied Nutraceutical International’s appeal to overturn the Food and Drug Administration’s 2004 decision to ban ephedra, a once popular weight-loss supplement.
The supplement was banned after the FDA determined that Ephedra caused a number of serious side effects including heart attack, stroke and death. Two years after the FDA banned Ephedra, an appeals court upheld the agency’s decision citing “the potential long-term harm to the user’s cardiovascular system.”
Earlier this month, the Supreme Court upheld the appellate court decision—despite Nutraceutical’s arguments regarding the safety of Ephedra at recommended doses. The company also accused the FDA of failing to thoroughly evaluate the supplement’s effects at lower dosage levels.
According to the FDA, Ephedra use presents a high risk of injury and/or illness at any dose.
Companies began marketing Ephedra in the 1980s and 1990s as a weight loss and athletic enhancement supplement. In the late 90s, however, the FDA began receiving reports of major, potentially fatal side effects associated with Ephedra use.
